Background

A. The Owner and Contractor are parties to Contract NCL-2025-041 for the Eastern Works Package at Northline Business Park.

B. Restricted access to the eastern work zone has affected the sequence in which the Contractor can perform the Works.

C. The parties wish to record the revised access arrangements and the Contractor's reservation of rights arising from that change.

Agreed terms

1. Direction

The Owner directs the Contractor to resequence the affected excavation, services and pavement works in accordance with the revised access programme issued with this Change Order.

2. Revised site access

Access to the eastern work zone will commence on 22 April 2026. Until that date, entry is limited to inspection, survey and other activities expressly approved in writing by the Superintendent.

3. Programme consequences

The Contractor must update its construction programme to reflect the revised access sequence. The parties acknowledge that the change may affect planned productivity, float and the timing of activities on the critical path.

4. Notice and reservation

Nothing in this Change Order constitutes agreement as to causation, entitlement or quantum. Northline expressly preserves all rights to claim an extension of time and delay costs arising from restricted access.

5. Records

The Contractor must keep daily records of labour, plant, access limits and affected activities, and provide those records with any notice arising from this Change Order.

6. Mitigation

The Contractor must take reasonable steps to reduce delay and notify the Superintendent before making any further change to the revised sequence.
